Welcome to our website. If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern SleepEatPlay.co.za’s relationship with you in relation to this website.

The term ‘Sleep Eat Play Africa CC’, ‘SleepEatPlay.co.za’, ‘us’ or ‘we’ refers to the owner / members of the website whose registered office is 5A Bristol House, 8B Shongweni Road, Hillcrest, 3610. The term ‘you’ refers to the user, viewer or establishment owner.

The use of this website is subject to the following terms of use:

1) NO BOOKING AGENTS – OWNERS ONLY

SleepEatPlay.co.za does not advertise on behalf of reservation agencies, holiday letting agents or anybody that makes bookings on behalf of an establishment for a fee/commission. This includes body corporate, developers or management companies who let out flats on behalf of owners and private individuals who market properties for holiday letting which they themselves, do not own.

2) REGISTRATION OF LISTINGS

In the case where an advertiser owns more than one establishment, SleepEatPlay.co.za requires that EACH establishment is be registered separately by the owner. SleepEatPlay.co.za will not allow more than one establishment per listing. If the establishments are on separate properties you need to complete an application form for each of your properties or businesses. Self-Catering establishments may be assessed by SleepEatPlay.co.za before being listed. SleepEatPlay.co.za may restrict the number of listings in a particular category or area at their discretion without notice.

SleepEatPlay.co.za deals directly with the owners/establishments only. Owners can create one (1) login profile and add multiple listings in different categories provided they own each of the establishments. Each listing is billed accordingly but provides one access point to manage them all.

Any advertiser found using the enquiries to promote additional establishments not listed on the SleepEatPlay.co.za website, will immediately have their establishments removed without a refund. Breaching of any rules will cause the applicable establishment to be removed from the SleepEatPlay.co.za website without a refund and a ban will be imposed restricting the establishment or the owner from ever listing with our website.

SleepEatPlay.co.za reserves the right to refuse unsuitable applications. SleepEatPlay.co.za also reserves the right to cancel any existing subscriptions related to public complaints or advertisements that do not comply with our policies, strategies or ethical business practices or in breach of any law. SleepEatPlay.co.za may also temporarily suspend or deactivate a listing at any time without notice if the listing is deemed to contain content that is not uniform to the rest of the website, or if it contains data/information not permitted or approved by the owners of this website.

3) PROVIDE ACCURATE INFORMATION

Advertisers/Owners are obliged to inform us of any important changes that take place at their establishments including changes to grading, rates, services, facilities or owner information. Please note that we will not list establishments in areas they are not located in, nor will we list establishments under categories that are not relevant to the establishment itself. Please note your registered business name must be used (as registered with your chosen accreditation association) for verification and marketing purposes.

All content published on the SleepEatPlay.co.za serves as a guide only and is for your general information and use only. It is subject to change without notice.

Whilst SleepEatPlay.co.za strives to ensure that the content contained within the website is accurate, we cannot be held responsible for the accuracy of information supplied by the individual establishments. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose.

All material supplied by these said establishments is used by SleepEatPlay.co.za on the basis that they own the rights to the said material. All other materials, but not limited to, the design, layout, look, appearance and graphics, establishment logos (if generated by SleepEatPlay.co.za), are the property of Sleep Eat Play Africa CC.

SleepEatPlay.co.za, and it's employees will not be held liable for any errors or omissions nor for any claims from any persons, for any reason whatsoever with regard to any establishment published on the SleepEatPlay.co.za website.

It is the responsibility of individuals browsing through the SleepEatPlay.co.za website to assure themselves as to the accuracy of the information by way of enquiry and/or checking directly with the establishment concerned.

4)   RIGHT TO EXCLUDE

We welcome all business listings reserving the right to exclude businesses which may impact negatively on the performance of other advertisers on Sleep Eat Play Africa network of websites.

5)   CHANGE OF OWNERSHIP

Should you sell your establishment/business whilst you are a advertiser on the SleepEatPlay.co.za website, it is part of our terms and conditions that you notify us to this effect in writing either via e-mail or by fax, such information is located on our contact us page. The new owner will be required to complete a new owner application form, and confirm that they have read and agree to our Terms & Conditions of Advertising.

6)   INVOICING AND PAYMENT

SleepEatPlay.co.za offers two payment options: Monthly payment plan and an annual upfront fee. Monthly subscriptions are month to month and incur an initial once off setup fee for the creation of their profile . Annual upfront payments receive discounted rates and not subject to the initial setup fee. The advertising fee is payable upon presentation of an invoice. The invoices are e-mailed to you on completion of your advertisement and are payable on presentation. Only once payment has cleared in the SleepEatPlay.co.za bank account will your establishment listing be made live/public. Monthly payment plans are by Debit Order only. Important to note should any establishment change ownership and SleepEatPlay.co.za has already issued an invoice to the old owners, this cannot be amended and the previous owner is liable to settle the outstanding invoice.Should it be necessary for us to take legal action due to non-payment of your account, you will be responsible for all administration and legal fees incurred.

7)   AFFILIATE / LISTING TRADE OFFs / FREE LISTINGS

SleepEatPlay.co.za does not provide a free listing service nor provide a free listing trade off facility based on commissions or referrals generated from our website. The website listing fees are charged for, but not limited to, covering the operational and development costs associated with the website, as well as the maintenance and marketing thereof. This ensures we offer a superior service to our clients and ensures that they receive value for money. Advertisers who pay to be listed benefit from the marketing and exposure of the SleepEatPlay.co.za website. SleepEatPlay.co.za will not entertain free listings based on referrals/leads. There is no accurate tracking method to ensure the leads/referrals are monitored, or if they were generated from our website as 99.9% of websites/clients have no solid way of tracking these leads. It also goes against our principles of a NO COMMISSION website.

8)   RENEWALS / CANCELLATIONS

Your advertisement is valid for the period for which you have paid the required subscription. Monthly subscriptions require a calendar months notice of cancellation. Annual subscriptions are valid for 12 months (1 year) or otherwise noted by the owners of SleepEatPlay.co.za. Approximately 1 (one) month prior to your annual advertisement subscription ending, SleepEatPlay.co.za will send you an e-mail informing you that your advertisement is due for renewal. You may then decide to cancel or renew the advertisement. It is a requirement and part of our terms and conditions that you advise us if you wish to cancel in advance of the renewal date. Failure to notify us of your intent to cancel amounts to a tacit renewal in which event fees for the following year become due and enforceable.

9)   ENQUIRIES / PRIVACY POLICY

Under no circumstances may advertisers send unsolicited e-mail to members of the public in response to enquiries they receive via the SleepEatPlay.co.za website. This includes auto-responders advertising other products, services and or other businesses/establishments. Any advertiser found to be violating this condition will have their advertisement removed without any discussion or refund. (Not respecting this condition negates our Privacy Policy and the promise we make to the public that their contact details will not be used for any purpose other than to respond to the enquiry they have made for the establishment they have chosen to enquire with).

10)   EARLY CANCELLATIONS

Early cancellations are not eligible for any refund and advertisements cannot be "changed" from one property to another property during the advertising period, nor can advertisements be "put on hold" and then re-instated again at a later time. Any monthly subscriber whom cancels and then subscribes will be subject to the initial setup fee again as establishments may be deleted from the database once cancelled.

11)   WEBSITE LINKS

From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

You may not create a link to this website from another website or document without prior written consent of Sleep Eat Play Africa CC/ SleepEatPlay.co.za.

12) UPDATES AND SPECIAL OFFERS

All updates to your advertisement/listing are done free of charge provided you make these changes through your Clientzone access panel where you can make the necessary changes yourselves. Any updates to listings sent to SleepEatPlay.co.za may incur an additional fee, currently R350 ex vat per hour or part thereof. This is subject to management’s discretion. All updates must be submitted to us in writing, no telephonic updates are accepted.

Our rates are subject to change without notice whether or not this is stipulated on any individual pages.

13) COPYRIGHT / OWNERSHIP / USE OF MATERIALS

This website and its content is copyright of Sleep Eat Play Africa CC. All rights reserved.

All content which is defined as any information, data, text, messages, articles, software, methods or processes, photos, video, graphics, music, sounds and any other material or services that are found on this site excluding Member Content. You may not modify, publish, retransmit, participate in the transfer or sale of, copy, create derivative works of, distribute, perform or display any of the content in any way.

Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

Sleep Eat Play Africa CC reserves the right to make changes, as and when they are deemed necessary, to any and all pages on the web site. This includes but is not limited to design layouts, search methods, content, all coding etc.

Sleep Eat Play Africa CC is not responsible for any breaching of copyright laws resulting from material supplied by the Advertiser and the Advertiser indemnifies Sleep Eat Play Africa CC against any action brought for breach of copyright or other rights from the use of such material supplied by the advertiser. Sleep Eat Play Africa CC may pass on such details to relevant authorities should any legal dispute or issue arise as a result of such breaches.

Sleep Eat Play Africa CC shall be entitled to reproduce part or whole of any photographic material supplied by the advertiser in the promotion of either the Advertiser’s business/establishment/property or the promotion of South Africa as a Tourist and business destination for the greater good of all advertisers on the site and the Tourism and Business Industry in general. (Specific requests for non-inclusion will be respected).

Your use of this website and any dispute arising out of such use of the website is subject to the laws of South Africa. Please note that we do business with our clients under the above terms and conditions. We are not bound by conditions or instructions by advertisers which conflict with these terms and conditions.

By using the SleepEatPlay.co.za website you acknowledge that you have read this agreement and agree to be bound by its terms and conditions.
